WHAT SHOULD YOU DO IF YOU ARE INJURED BY A SOMEONE WHO APPEARS TO BE DRUNK DRIVING OR IMPAIRED WHILE OPERATING A VEHICLE?

First of all, the person doesn’t have to be fall down drunk to be impaired. Check out these definitions of DWAI and DUI found at noduicolorado.org:

Driving While Ability Impaired (DWAI) – If your ability is impaired to the “slightest degree” by alcohol, drugs or even prescription medications, or if your blood alcohol content (BAC) is found to be in excess of .05 but less than .08, you can be charged with DWAI.

Driving Under the Influence (DUI)  If you are “substantially incapable” of operating a vehicle after consuming alcohol, drugs or prescription medications, or if your blood alcohol content (BAC) is at or above .08.

IF YOU SUSPECT SOMEONE WHO HIT YOU IS IMPAIRED:

  • It is imperative that you call the police and tell them your suspicion so they can be assess the person and write an accident report.
  • And before it is too late, record the license plate number in case the driver tries to leave the scene.
